These Terms and Conditions ("Terms") govern your access to and use of the Business Phone iOS application and related services (collectively, the "Service"). The Service is provided by Business Phone ("Business Phone," "we," "our," or "us").
By downloading, installing, accessing, subscribing to, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service and uninstall the app.
Important Emergency Calling Notice
The Service is not a replacement for your mobile carrier, landline, or any traditional telephone service.
Business Phone is not designed or intended to provide reliable access to 911, emergency calling, hospitals, law enforcement, medical providers, public safety answering points, or other emergency services. You must maintain another reliable way to contact emergency services, such as a mobile phone or landline that supports emergency calling.
If the app attempts to route an emergency call through your native phone service, we do not guarantee that the call will connect, route correctly, transmit your location, or be handled properly. You are responsible for ensuring that you and anyone who may rely on your device have access to emergency calling outside the Service.
Eligibility and Account Responsibility
You must be legally able to enter into these Terms and use the Service under applicable law. You are responsible for all activity under your account, device, assigned phone numbers, and subscription.
You agree to keep your device and account secure and to notify us if you believe your account or assigned number has been used without authorization. You accept responsibility for consequences, damages, losses, or liability that may arise from unauthorized use caused by your failure to protect your device, account, or credentials.
License to Use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Business Phone iOS app on Apple-branded devices that you own or control, solely for lawful personal or business communication.
You may not:
- Sell, rent, lease, sublicense, distribute, host, or commercially exploit the app or Service except as allowed by these Terms.
- Copy, modify, translate, adapt, reverse engineer, decompile, disassemble, or create derivative works from the app except where prohibited from restriction by applicable law.
- Use the Service to build, benchmark, or support a competing service.
- Remove copyright, trademark, proprietary, or legal notices from the app.
- Interfere with, overload, disrupt, or attempt unauthorized access to the app, backend systems, networks, user accounts, or service providers.
We reserve all rights not expressly granted to you.
Phone Numbers and Communications Service
Business Phone may allow you to search, reserve, purchase, assign, use, release, and manage phone numbers through third-party communications providers.
You understand and agree that:
- Assigned numbers are provided for use with the Service and are not sold to you.
- We may reclaim, release, suspend, or reassign numbers if your subscription expires, your account is deleted, the number is inactive, the number is required by a provider or regulator, or you violate these Terms.
- Number availability, activation, SMS/MMS support, inbound calling, outbound calling, call quality, delivery, caller ID, and routing may depend on third-party providers, carriers, networks, Apple services, internet connectivity, and regulatory requirements.
- You must use phone numbers with your true identity and in compliance with applicable laws, carrier policies, messaging rules, and telecom regulations.
- You are responsible for ensuring that your communications are lawful and authorized.
We may suspend, limit, block, or terminate calling, messaging, number provisioning, or account access without liability if we believe your use is abnormal, abusive, fraudulent, unlawful, high-risk, or inconsistent with carrier, CTIA, FCC, TCPA, anti-spam, anti-fraud, or other applicable standards.
Acceptable Use
You agree not to use the Service to:
- Violate any law, regulation, court order, contract, carrier rule, or third-party right.
- Send spam, unsolicited messages, bulk messaging, robocalls, phishing, scams, fraudulent communications, deceptive content, or unauthorized marketing.
- Harass, threaten, abuse, defame, intimidate, impersonate, stalk, exploit, or harm any person.
- Send or store unlawful, hateful, discriminatory, sexually explicit, violent, exploitative, invasive, misleading, or otherwise harmful content.
- Violate intellectual property, privacy, publicity, confidentiality, or data protection rights.
- Interfere with emergency services, public safety, law enforcement, or regulated communications systems.
- Attempt to bypass usage limits, subscription requirements, security controls, abuse controls, number restrictions, carrier filters, or provider policies.
- Use the Service for illegal, fraudulent, harmful, or deceptive business practices.
We may investigate suspected violations and may remove content, block messages, block numbers, suspend features, release numbers, terminate accounts, or cooperate with providers, regulators, or law enforcement where appropriate.
User Content
"User Content" means content you create, send, receive, upload, store, or otherwise process through the Service, including SMS, MMS, media attachments, contact-selected information, call records, and support communications.
You are responsible for your User Content and represent that you have all rights and permissions needed to use it with the Service. You grant us and our service providers a limited license to host, store, copy, transmit, display, process, route, format, and otherwise use User Content only as needed to provide, maintain, secure, troubleshoot, and improve the Service, comply with law, prevent abuse, and enforce these Terms.
We are not obligated to back up User Content and may delete it as permitted by these Terms, our Privacy Policy, operational needs, account deletion, provider requirements, or applicable law.
Contacts, Permissions, and Device Features
The app may request access to device features such as contacts, microphone, notifications, photos, files, camera, and calling-related iOS capabilities. You can manage permissions through iOS settings.
Some features may not work if permissions are denied, disabled, or later revoked.
Subscriptions, Billing, and Refunds
Business Phone may offer paid subscriptions, trials, and in-app purchases through Apple. Prices, plan limits, included features, renewal periods, and availability may change from time to time.
Purchases are processed by Apple through your Apple ID. Your subscription may renew automatically unless canceled through your Apple ID subscription settings before the renewal date. We do not control Apple billing, Apple payment methods, Apple refund decisions, or App Store account settings.
Refund requests for App Store purchases must be submitted to Apple according to Apple's refund process and policies.
If a subscription expires, is canceled, refunded, reversed, disputed, or cannot be verified, we may limit or suspend paid features and may reclaim assigned numbers as permitted by these Terms.
Fees, Carrier Charges, and Connectivity
You are responsible for any data, voice, messaging, roaming, internet, carrier, or device charges that may apply when using the Service. Your mobile carrier, internet provider, workplace network, or device settings may restrict or affect VoIP, SMS/MMS, push notifications, or app connectivity.
We are not responsible for charges imposed by your carrier, internet provider, Apple, or other third parties.

If you send us feedback, suggestions, ideas, bug reports, or improvement requests, you agree that we may use them without restriction or compensation to you. Do not send confidential or proprietary information unless we have separately agreed in writing.
Third-Party Services
The Service depends on third-party services and platforms, including Apple, Firebase/Google Cloud, Telnyx, RevenueCat, carriers, internet providers, and other infrastructure, communications, billing, security, storage, notification, and support providers.
We are not responsible for third-party services, outages, restrictions, decisions, fees, terms, privacy practices, or failures. Your use of third-party platforms may also be subject to their own terms and policies.
Apple is not responsible for the Service, support, claims, warranties, or legal compliance except as required by applicable App Store terms. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the app on Apple platforms.
Changes to the Service
We may modify, suspend, limit, discontinue, or remove any part of the Service at any time, with or without notice, including features, plans, pricing, usage limits, phone number availability, and provider integrations.
We are not liable for any modification, suspension, discontinuation, loss of access, number release, feature change, or provider limitation, except where prohibited by law.
Termination
These Terms remain in effect while you use the Service.
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, created legal or operational risk, failed to maintain an active subscription for paid features, misused the Service, or engaged in abusive, fraudulent, unlawful, or harmful activity.
You may stop using the Service at any time. You may also delete your account where the app provides that option. Account deletion may release assigned phone numbers and remove account data as described in our Privacy Policy.
Sections that by their nature should survive termination will survive, including ownership, acceptable use violations, payment obligations, disclaimers, limitation of liability, indemnity, dispute terms, and general provisions.
Ownership
The app, Service, software, designs, trademarks, logos, content, documentation, systems, and related intellectual property are owned by Business Phone or our licensors. You receive only the limited license described in these Terms.
You may not use our name, branding, logos, or marks without our prior written permission.
Disclaimer of Warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, call quality, message delivery, number availability, and uninterrupted or error-free operation.
We do not guarantee that calls or messages will connect, be delivered, be received, be timely, be secure, or be free from provider filtering, carrier blocking, outages, delays, or errors.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, Business Phone and our service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, communications, phone numbers, goodwill, business, revenue, or access, arising from or related to the Service or these Terms.
To the maximum extent permitted by law, our total liability for any claim related to the Service or these Terms will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
Indemnity
You agree to defend, indemnify, and hold harmless Business Phone, our affiliates, service providers, licensors, officers, directors, employees, contractors, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:
- Your use or misuse of the Service.
- Your User Content or communications.
- Your violation of these Terms.
- Your violation of any law, regulation, carrier rule, provider policy, or third-party right.
- Unauthorized or abusive use of your account, device, subscription, or assigned numbers.
We may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us.
Changes to These Terms
We may update these Terms from time to time. If we make changes, we will update the "Last updated" date above. Changes are effective when made available in the app or otherwise provided to you, unless a later date is stated.
Your continued use of the Service after changes become effective means you accept the updated Terms.
Governing Law
These Terms are governed by the laws applicable in the jurisdiction where Business Phone operates, without regard to conflict-of-law principles, unless applicable consumer protection law requires otherwise.
General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of law.
These Terms, together with the Privacy Policy and any purchase terms shown in the app or App Store, form the entire agreement between you and Business Phone regarding the Service.
